Acceptance of These Terms
These terms apply to the Pickled iOS app and this website. By downloading or using Pickled, you agree to them. If you download Pickled from the App Store, Apple's standard Licensed Application End User License Agreement also applies to your use of the app; where the two conflict, these terms govern to the extent permitted.
What Pickled Is (and Isn't)
Pickled is an AI pickleball companion. It captures your games, generates highlight clips, keeps rally statistics, and offers a second opinion on close moments, including an IN, OUT, or TOO CLOSE reading with a measured margin.
Pickled is not a referee. Its analysis is an estimate produced by on-device computer vision, and its accuracy depends on camera placement, lighting, footage quality, and factors outside anyone's control. It is provided for personal review and enjoyment. Do not rely on Pickled to officiate matches, settle disputes, decide competitions, or for wagering of any kind. When Pickled itself is unsure, it says TOO CLOSE rather than guessing. Treat every call it does make in the same spirit: a second opinion, not the final word.
Your Content
Video you record or import, and the clips and statistics Pickled creates from it, are yours. Pickled claims no ownership of your content. Because processing happens on your device and the app has no servers, Pickled never receives a copy of it. You are responsible for the content you record and for what you do with clips you share.
Recording Responsibly
You are responsible for complying with the laws and rules that apply where you record, including obtaining any consent required from people who appear in your footage and following the policies of the venues where you play. Recording laws vary by place; if you are unsure, ask the people you're filming. It's also just good manners on a shared court.
Acceptable Use
Don't misuse Pickled. In particular, don't use it to record people unlawfully or harass them; don't attempt to reverse engineer, resell, or misrepresent the app; and don't present Pickled's output as an official ruling or use it in any scheme involving gambling on match outcomes.
Disclaimers
Pickled is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and accuracy of results. We do not warrant that calls, statistics, or highlights will be accurate, complete, or uninterrupted. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.
Limitation of Liability
To the maximum extent permitted by law, Pickled and its developer will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or disputes arising from gameplay decisions, in connection with your use of the app or website. To the extent liability cannot be excluded, it is limited to the amount you paid for the app in the twelve months before the claim arose.
Changes
We may update the app, the website, and these terms over time. Material changes to these terms will be posted here with a new effective date. Continuing to use Pickled after a change takes effect means you accept the updated terms.
General
If any provision of these terms is found unenforceable, the remaining provisions stay in effect. These terms are the entire agreement between you and Pickled about the app and website, and are governed by the law applicable in your place of habitual residence where consumer law so requires.
